Reasonable Use Terms

The NLXP provides stakeholders with access to a common, national level crossing safety dataset, which is intended to facilitate informed understanding and analysis of safety issues and collaboration across stakeholders for safety improvement. In using the NLXP, stakeholder users are expected to:

  • Use the data responsibly and ethically for purposes directly relevant to their role and their organisation’s functions in managing or improving level crossing safety.
  • Treat the data as confidential and protect it from unauthorised access as would be expected under their organisation’s data management practices for data of a similar nature.

Access to the NLXP is not provided for users to simply replicate the information for publication. The detailed data provided in the NLXP is to enable users to tailor the data to their specific purpose.

Reasonable use would include:

  • Use of data to support a user’s research, risk assessment, and/or safety assessment and decision-making processes.
  • Summary of the data analysis used to inform research findings, risk assessment or decisions.
  • Publication of data relating to crossing that are the direct management responsibility of the user (or user’s organisation).
  • Presentation of aggregated data to support benchmarking.
  • Identification of other road and/or rail managers that may be experiencing similar crossing occurrences for collaboration purposes.

Reasonable use does not include:

  • Direct release or publication of data from the NLXP dataset.
  • Publication of data that identifies organisation's (without obtaining consent), other than the user’s own organisation.

Reasonable use of NLXP data will aid in continuing to build this information resource. Misuse or inappropriate disclosure of NLXP data will undermine the willingness to provide data to the detriment of all stakeholders.
